Montgomery Circuit Judge William Shashy ruled today that the state must return seized gambling machines and money to VictoryLand unless it takes action against other bingo casinos in Alabama, reported wsfa.com.
Shashy said, “This Court will not be used as an instrument to perpetuate this unfair treatment,” giving the state 45 days to take action against six other casinos in the state.
In June, Shashy accused Alabama Attorney General Luther Strange of “cherry picking” and ruled the slot machine-type games should be released back to the casino. Today’s ruling is the latest in a series of appeals and rulings in an effort to settle the question of whether these machines are legal in Alabama.
Strange said in a statement that the state “strongly disagrees” with the ruling and will be appealing the ruling and “be guided by the Supreme Court.”
